Estate and Gift Tax Planning Under the 2010 Tax Relief Act

On December 17, 2010, President Obama signed the Tax Relief, Unemployment Insurance Reauthorization and Job Creation Act of 2010 (Act). The Act provides significant changes related to individual income tax and estate and gift tax, including certain provisions related to the alternative minimum tax (AMT) and generation-skipping transfer taxes. The implications for estate planners, especially for 2011 and 2012 under the Act are both significant and unsettling. This article outlines a few of the main points.
